Abstract [eng] The Concept of State Sovereignty in the Modern International Law The notion of “state sovereignty” is the basic concept of modern international law. This relative concept has recently become a major bone of contention within international law. Issue is whether sovereignty could be restrained in favour of increasing international cooperation growth which tends to be asserted as a threat or sovereignty destructive power. Absoluteness of sovereignty is controversial, it is unthinkable without international law itself. National identity sustained an allegiance to the public good – protection of human rights, state sovereignty and integrity. Massive development of international cooperation is determined numerous international conflicts, progressive development of military sources and methods. Principles of international law are core guarantees of state sovereign equality, territorial integrity and boundary inviolability. Although, International Court of Justice and Tribunal of Law of the Sea recent case analysis, also latest agenda of Security Council and General Assembly resolutions reveal the fact of long-lasting conflicts between states. Vestfalian sovereignty still remains actual as a defensive claim of sovereign states. On the other hand, concerning its historical and political discourse, sovereignty is open to change. Transferring sovereign rights to supranational bodies does not presupposes the loss of sovereignty itself. The way state implements its supreme authority directly depends on exclusive competence of this state.
