This master thesis is based on research about health and safety at work, which is legitimated by international legal sources and national legislation. With the help of different regulations basic duties of employer and employee are analyzed. In order to ensure the consistency of this master thesis all conclusions are based on different and structured findings from a number of sources. The final thesis is divided into three parts, which are divided into subsections. In the first part the general conception of health and safety at work is analyzed: main conclusions are made according to information from different and relevant sources. In the second chapter the main master thesis part is developed. This part is analyzed through three main aspects: basic state’s, employer‘s and employee‘s duties in health and safety at work area. The third part consists of liability and conditions of liability implementation to employers and employees, analysis of European Court of Justice and Lithuanian Supreme Court legal practice. In this master thesis not only international, but also national regulation of duties of employer and employee is discussed. This regulation has a great impact and practical value developing relations, which could be valuable for both parties of labour relations. The concept of these relations depends on implementation and supervision of specific labour relations related duties. With the help of this master thesis basic duties of labour relations parties are developed in order to ensure practical value for implementation of health and safety at work requirements. |
