Abstract [eng] Theoretical and Practical Problems of Legal Regulation of Foreigners’ Employment The object of this Master‘s thesis is to analyze the most relevant legislation of the Republic of Lithuania and the European Union that regulates the employment of nationals of the European Union Member states and third-countries in the territories of the European Union Member States, by providing an examination of the definitions used in the regulation of this legal area, revealing essence of the above mentioned definitions, reviewing their essential elements and also taking into account opinions of various legal scientists that are given in legal doctrine. This thesis consists of four sections. In the first section of this thesis the complete analysis is presented of the definitions and concepts that are used in the regulation of the employment of foreign nationals, also the full evaluation is given of the above mentioned definitions that are used in the national legislation of the Republic of Lithuania and their compliance with the definitions entrenched in the terminology of supranational regulation. The second section analyzes the regulation of the employment of nationals of the European Union, its peculiarities, legal limitations and exceptions. Also in this section it is determined whether the national regulation of the Republic of Lithuania of this respective area ensures the protection of all rights of nationals‘ of the European Union. The third section of this thesis is intended to analyze the procedures of the employment of nationals of the third-countries in the labour market of the Republic of Lithuania to determine whether such legislation of this respective area upholds proper balance between the protection of the internal labour market (and its participants‘ rights) and stimulation of the competitivness of the state (and private) entities using foreign labour force. The fourth section analyzes the latest regulation of the Republic of Lithuania of the employment of foreign nationals that came into force in 2017, determining the advantages and disadvantages of this regulation and identifying tendencies of the regulatory changes, and also performing the comparative analysis of the old and new regulations of this area.
