Summary Master’s thesis describes the labor and rest period in transport sector by introducing the labor and rest period conception, legal regulation and its particularity. The labor and rest period are two interrelated concepts, therefore understanding these ideas and the proper consolidation of legislation is to create a safe and healthy working environment. Before examining the labor and rest period in individual transport sectors it was crucial to analyze the labor and rest period concepts governed by different legislations. The work and rest period in the transport sector are regulated by international law, European Union law and by national law. Transport sector belong to the economic activity area, therefore to regulate accordingly the labor and rest period the Republic of Lithuania Government May 3, 2003 resolution No. 587 “Dėl darbų, kuriuose gali būti taikoma iki dvidešimt keturių valandų per parą darbo laiko trukmė, sąrašo. Darbo ir poilsio laiko ypatumų ekonominės veiklos srityse. Darbų, sąlygų, kurioms esant gali būti įvedama suminė darbo laiko apskaita, suminės darbo laiko apskaitos įvedimo įmonėse, įstaigose, organizacijose tvarkos aprašo patvirtinimo“ is applied. The mentioned Government resolution terms are reconciled with the European Union law (transposed either into national law or applied directly) to establish detailed work and rest period peculiarities, for example specific categories of workers are enabled to work up to 24 hours a day, the application of total working time and rest time allocation on specific periods. Master’s thesis objective is to examine in detail the labor and rest period in different fields of transport (road transport, railway transport, sea transport, inland water transport and civil aviation) while examining the labor and rest time regulation of a variety of legislations, identifying common problems in case law. |
