Master thesis analyses constituent elements of criminal bankruptcy crime and its problems. First part of the thesis analyses the definition of bankruptcy, historical development of criminal bankruptcy crime. Second part of the thesis examines constituent elements of criminal bankruptcy crime, demarcation of similar crimes and fraudulent bankruptcy, evaluates validity of the sanction. In the last part of the thesis criminal bankruptcy crime is compared to similar crimes in foreign countries. Federal Republic of Germany, Federal Republic of Russia and Republic of Estonia criminal codes are picked as the basis for comparison. Thesis was prepared in accordance with the most relevant Supreme Court of Lithuania and lower court cases. Every part of the thesis has problematic aspects and authors position on these matters. |
