Abstract [eng] Performance of Employment Contract: Theory and Practice Employment contract and its implementation in each individual case is different. It is important to understand regulation of peculiarities, distinguish and explore performance of the contract, which causes more law disputes. It is important that the aim of the legislature ensures the employee and employer needs. This Master thesis is relevant that problems are identified through court cases and proceedings. The object of this research is: performance of employment contract. The aim of the research is to analyse the concept of employment contract, also analyse main and detailed theoretical aspects. As well as present and analyse court cases. In order to reach the aim of this research, the following objectives have been raised: first, explaining concept of the employment contract, second, to analyse the peculiarities of legal regulation, third, to explore suspended problematic aspects of employment contract, and fourth, to investigate practical problems and relevant case-law. The Master thesis consists of four chapters. The first chapter contains of employment contract conception. In the second chapter the legal interpretation of the regulation is provided. In the third chapter includes suspended problematic aspects of employment contract, and fourth, analysis and investigation in case-law which represents problematic aspects. Conclusion is, that the employment contract concept is broader than provided in scientific publications. Moreover, it is appropriate to improve some employment contract areas (for example: downtime case, an employee who is under the influence of alcohol and etc.). Case study revealed, that discussion and contention mostly arise from the modification of employment contract, wage and its replacement, by the way, downtime institute.
