Abstract [eng] Peculiarities of Transport Labour Relations Transport labour relations are very specific and are characterized by unique peculiarities in comparison to ordinary labour relations. These peculiarities require to regulate transport labour relations differently, and ensure functioning of such regulation. As a constituent part of the economic and social infrastructure of the Republic of Lithuania, transport is also recognized as one of the most precarious economic activity as the drivers of motor vehicles, railroad, ship or aircraft crew members perform work while travelling, and may be affected by a variety of factors such as hazards to their health, a great responsibility in ensuring the carriage of freight or passengers, working in extreme weather conditions, at nights, etc. This master thesis examines a concept of the transport sector, and the law applicable to labour relations in this sector, especially focusing on questions regarding recruitment, employment contracts as well as peculiarities of work and rest conditions and remuneration. With regard to differences among the analysed institutions as well as the nature of violations of national labour law, and disputes in courts, this study accentuates the legislation, doctrine and relevant case-law governing the peculiarities of land, air and maritime transport labour relations. It is noted that the particular attention is paid to the draft Labour Code planned to be adopted in 2016. The fact that transport workers carry out their work functions by constantly moving and/or crossing borders has prompted to provide in this study a profound analysis of comparison between the relevant legal regulation in Lithuania and European Community. The master thesis is summed up with conclusions, and recommendations on how to improve regulation of transport labour relations are provided.
