This master’s thesis is analysis of trading in influence – the crime established in Criminal Code of Republic of Lithuania. The aim of this research is to identify problematic elements of this crime and offer probable legal solutions, which would help to trading in influence. First section is dedicated to examination of the concept of trading in influence and chronological analysis of legislation during 2000−2015 related to trading in influence and affect it made to legal theory and practice. Second section highlights imperfection of some exact elements of crime by successively analyzing them and offers the ways to overcome legislation imperfections. In the third part reveals relation between trading in influence and other similar crimes as well as lobbying activities. Analysis offers exact elements of crime which distinguishes trading in influence from other specific crimes and defines the difference between trading in influence and lobbying. |
