Abstract [eng] Law Applicable to Consumer Contractual Relations This master thesis analyzes the law applicable to consumer contracts in EU. The main legal acts of this subject – Rome Convention, Rome I Regulation, Brussels I Regulation and some Directives on consumer rights – are discussed. The main objective of this thesis is by analyzing legal acts mentioned above, their effects and issues arising in the case law, to discuss features of the law applicable to consumer contracts, to mark out the main issues and give particular solutions and proposals. The first part of the thesis is historical analysis of Rome Convention and Rome I Regulation. This part helps to answer if regulation of the law applicable to consumer contracts provides more protection to consumer now. The second part scrutinize the relationship between Rome I Regulation and Brussels I Regulation and relation between Rome I Regulation and Directives, also some issues are discussed. In the third part of this paper, the principle of autonomy and its possible models in law applicable to consumer contracts is presented. In addition to, this part gives the answer if the current autonomy of the parties model is the most favourable to consumer contracts. The fourth part is dedicated to evaluation of targeted activity criterion. Regulation and the interpretations of case law of the ECJ is analysed in this part. The last part of this paper analyses the law applicable to active consumer and the law applicable to consumer in contracts of carriage and insurance in Rome I regulation.
