Inheritance by Right of Representation: Comparative Aspects In this Master’s thesis Vilnius University fifth course student Vilius Jakštas will analyse inheritance by right of representation, comparison aspects. Inheritance by right of representation is one of inheritance means that can be used in accordance with law, this institute is closely connected to inheritance itself, therefore while analysing this topic it is necessary to practise inheritance norms that are in effect in connection with inheritance by representation. The current situation and place of inheritance by representation norm in Lithuania is analysed and provided in this thesis. Main aspects that will be compared between Lithuania and other countries are provided. Other countries norms that regulate inheritance by right of representation is provided and analysed. Not only main aspects are distinguished in this thesis that’s can be compared in connection with Lithuania’s law, but also the exclusive aspects are distinguished that are only usable in certain country or territory. The full analysis and comparison between main and exclusive aspects in connection with Lithuania’s norms are provided. Possible benefit and need of exclusive aspects are analysed in connection with Lithuania’s norms. After analysis and comparison of different norms and aspects that regulate inheritance by right of representation the conclusion is made whether norm that regulates inheritance by right of representation in Lithuania and which has been adopted in year 2001, but have not changed the essence of norm since 1964 is still sufficient and topical till this day. |
