Abstract [eng] Harmonisation of Law Applicable to Inheritance Relations in the European Union The title of this master's thesis is Harmonization of Law Applicable to Inheritance Relations in the European Union. The objective of this thesis is to answer and assess how did the Regulation affect law applicable to Inheritance relations in the European Union, in the same time it is examined whether the level of desired harmonization has been achieved and why exactly these norms have been enacted in the Regulation while trying to achieve harmonization of law applicable to inheritance relations in the European Union. In this thesis the problematic aspects of the Regulation are examined in a broad sense, while assessing them and suggesting alternatives and solutions. The first part of thesis is dedicated to discuss the chosen way of harmonizing Private and Inheritance law in the European Union, it is analyzed what are the positive aspects of the chosen way of harmonization, possible alternatives and reasons. In other words the objective of the first part of this thesis is to analyze and provide a reasoned position in regard to the chosen way of harmonizing law applicable to Inheritance relations in the European Union. The second part of thesis provides an analysis of isolated Regulation problematic aspects in order to reveal the Regulations problems. This analysis objective is to reveal the possible practical problems in the future, their possible consequences and to determine whether the original objectives of the Regulation can be implemented in the future without additional problems. This part also aims to provide, possible solutions to the analyzed problematic aspects by making possible hypothetical situations and presenting a reasoned position on possible solutions to such situations. The third part deals with the problems associated with the United Kingdom, Ireland and Denmark, which have refused to join the Regulation. Analyzing why did these Member States do so and analyzing how the regulation will affect them . In the fourth part of the work a systematic assessment of the Regulation is carried out in order to reveal how it will function with the discussed and isolated problems. Moreover in this part of the thesis an assessment whether the desired result of inheritance rights in the European Union harmonization has been achieved and an analysis is given for possible future prospects in this area. Given the fact that the topic is quite complex and and he fact that there are many different aspects of European Union law and inheritance law that are needed to be analyzed, the fourth part of the work is being ended with a subsection that concisely gives the most important information in order to receive a better understanding of the subject.
