In this master’s thesis, the European refugee crisis, European Union law and the actions taken by the European Union institutions as well as its Member States during the European refugee crisis are examined. Special attention is paid to the complex analysis of the European Union law in the context of the European refugee crisis. The first part of the thesis is dedicated to defining the European refugee crisis that began in 2015. Consequently, the second and third part is for distinguishing the main legal instruments adopted by the European Union and their Member States before and after the European refugee crisis. And the fourth part examines the main shortcomings of the European Union law and its legal regulation observed during the European refugee crisis and presents possible solutions for the improvement of this system. The master’s thesis presents the European refugee crisis as a unique crisis, during which most European countries could not respond to the consequences of the crisis on their own due to their membership in the European Union and had to apply European Union law. The main instruments of the European Union and their Member States to regulate migration during the European refugee crisis were the legislation establishing the Common European Asylum System. During the European refugee crisis, ad hoc decisions were taken on the resettlement of the refugees from Italy and Greece to other Member States and the treaty between Turkey and the European Union was adopted. In order to close the existing gaps, the legislation forming the Common European Asylum System should be further improved, with mechanisms in place that are prepared for and adapted to crisis situations. |
